EVERYDAYACTION

Terms

Terms of Service, Privacy Policy and Disclaimers. One page, everything in it.

Effective date: October 21, 2026. Last updated: October 21, 2026.

This page is the agreement between you and EverydayAction for everything we offer: the website, free resources, digital products, the community, live calls and private coaching. It also explains what we do with your information. If you are a coaching client, your signed Coaching Agreement works alongside this page.

ON THIS PAGE

The short version

Read the whole page. This part is a plain summary so nothing below comes as a surprise. It doesn't replace the full terms.

If you ticked "I accept the Terms of Service and Privacy Policy" at checkout, this page is what you agreed to. That includes the refund policy in section 9 and, for coaching, your signed Coaching Agreement.

  • Coaching is a commitment. Twelve one-to-one sessions over twelve weeks. Payments are final and non-refundable, there are no pauses, and a payment plan is a promise to pay the full plan.
  • Digital products are final once you have access. If something is broken or you were charged twice, we fix it or refund it.
  • Talk to us before your bank. If you have a problem with a charge, email us first. Most things get solved in a day.
  • This is coaching, not therapy. It isn't medical, mental health, legal or financial advice. If you are in crisis, call 988 in the US, 112 in Europe, or your local emergency number.
  • No guaranteed results. The work is yours. What other clients got is a past fact about them, not a promise about you.
  • Sessions are recorded. Recordings, transcripts and assessments are used to coach you, to measure progress and, with your identity removed, for case studies and research. Your name is only attached with your separate written OK.
  • We don't sell your personal information. We use trusted services to run the business, and you can ask to see, correct or delete your data.
  • You must be 18 or older.

PART 1

Terms of Service

1. Who we are

EverydayAction is a trade name of Charest-Weinberg Gallery, LLC, a Delaware limited liability company. "EverydayAction," "we," "us" and "our" mean that company. "You" means anyone who visits everydayactioncoach.com, signs up for anything, buys anything, joins the community or works with us as a coaching client. Our coach is Eric Fate.

Contact: [email protected]. Mail: 3411 Silverside Road, Tatnall Building, Suite 104, Wilmington, DE 19810, USA.

2. How you agree to these terms

You agree to these terms when you do any of the following: use the website, submit a form, apply for a clarity call, create an account, tick the box at checkout, complete a purchase, sign a Coaching Agreement, or join a live call or the community. If you don't agree, please don't use EverydayAction.

We keep a record of how and when you agreed, including the time, the version of these terms, and, at checkout or signing, technical details such as your IP address. That record can be shown to a payment provider if a charge is ever disputed.

3. Which document wins

  • Coaching clients: your signed Coaching Agreement controls your coaching program. This page adds detail and covers everything the Agreement doesn't. If the two ever conflict, the signed Agreement wins.
  • The Mental Load Conversation and The Handoff: these tools show a short notice inside the tool about the anonymous answers they keep. That notice is part of these terms and wins on anything specific to the tools.
  • Everything else: this page.

4. Who can use EverydayAction

You must be at least 18 years old and able to enter a binding contract. EverydayAction is not for children. If you use EverydayAction on behalf of a company, you confirm you are allowed to accept these terms for it.

5. Your account

Some things need an account on our platform, Kajabi. Keep your login to yourself and give us accurate information. Accounts are personal. Don't share access to paid content or the community with anyone else. Tell us straight away if you think someone else has used your account.

6. What we offer

  • Free resources: articles, guides, the newsletter, templates, free courses and lessons in the member library.
  • Digital products: paid courses, tools and downloads, such as The Handoff. Some tools, such as The Mental Load Conversation, are free. You get a personal, non-transferable licence to use them for yourself.
  • The community: the EverydayAction community on Kajabi, where members can post and talk.
  • Live calls: group calls such as Thursday Live. Times can change, and we may record them.
  • Private coaching: the twelve-week one-to-one program, covered in section 7.

We may change, update or stop offering any free resource, product or feature. If we discontinue a paid digital product you bought, we'll give you reasonable notice and a way to keep your own results or materials where we can.

7. Private coaching

This section summarises how the coaching program works. Your signed Coaching Agreement has the full terms and controls if anything differs.

7.1 How you get in

Coaching is by application only. You complete the application, then we meet on a free clarity call of about forty-five minutes. Being able to pay is not enough to get in. We only take clients we believe we can help, and we can decline any application without giving a reason. If we both decide to go ahead, you sign the Coaching Agreement, pay, and we book your first session.

7.2 What's included

  • Twelve one-to-one coaching sessions of sixty minutes each, held weekly by video call. A session that runs longer is a courtesy, not an obligation.
  • Access to the EverydayAction community on Kajabi.
  • Chat support by WhatsApp, with a reply within twenty-four hours, Monday to Friday, excluding US federal holidays. Replies outside that window are at our discretion.
  • Supplemental work built for you, such as prompts, exercises and practices.
  • Two short assessments each session and a progress summary at the end of the program.

7.3 Scheduling, rescheduling and missed sessions

  • All twelve sessions take place within the twelve-week program window.
  • You can reschedule up to three sessions during the program, with at least twenty-four hours' notice. Rescheduled sessions should be rebooked in the same week where reasonably possible.
  • If you are more than fifteen minutes late, the session is forfeited and counts as used.
  • A session missed without notice is forfeited and non-refundable.
  • Sessions not used within the program window expire. They are not refunded or carried over, unless we agree otherwise in writing.
  • If we have to move a session, we rebook it with you inside the window at no cost.

7.4 Assessments

You agree to complete an arrival assessment at the start of each session, which takes under a minute, and a weekly assessment within four hours of each session ending. Your answers are how your progress is measured and the basis for your end-of-program summary. If assessments are skipped, we can't produce a complete summary.

7.5 Your part

Coaching works when you show up, tell the truth and do the work between sessions. You are responsible for your own decisions, actions and results during and after the program.

7.6 When we can end the program

We can limit, suspend or end your participation, without refund and without cancelling remaining payments, if you become abusive, disruptive or unsafe to work with, repeatedly ignore the program guidelines, or interfere with other clients, members or staff. If we can't hold a session for a reason on our side, we rebook it with you within the program window, or extend the window to fit it.

7.7 Confidentiality

What you share in coaching stays private, subject to the recording and anonymised data rights in section 12 and the limits below. Our tools, materials and frameworks are confidential too, and are for your personal use only. We may have to share information without your permission if the law requires it, or if we believe someone is at serious risk of harm.

7.8 After twelve weeks

A program ends after twelve weeks. Continuing is optional and is agreed separately in writing, at the price and terms set out at that time.

8. Prices and payment

  • Prices are shown in US dollars on the relevant page and at checkout. The price you pay is the one shown when you buy or sign. We can change prices for future purchases at any time.
  • At the time of writing, private coaching is $3,297 paid in full, or three monthly payments of $1,265 ($3,795 in total). The payment plan costs more because we carry it.
  • Payments are processed by our checkout provider, Kajabi, and payment processors such as Stripe and PayPal. We never see or store your full card number.
  • You may be offered buy-now-pay-later options such as Klarna or Afterpay. That arrangement is between you and that provider, on their terms and rates. We are paid in full when you buy, and our refund policy below applies to the purchase.
  • You are responsible for any bank, currency conversion or foreign transaction fees your card provider charges, and any taxes that apply to you.
  • Charges will appear on your statement as EverydayAction, or a close variation of it.

8.1 Payment plans

A payment plan is a commitment to pay the full plan amount. It is not a subscription you can cancel. By choosing a plan, you authorise us to charge your payment method automatically on each due date until the plan is paid. Stopping coaching, missing sessions or deciding not to continue does not end the obligation to pay the remaining payments.

8.2 Failed payments

If a payment fails, we'll let you know and retry it. You agree to update your payment details promptly. If a payment stays unpaid for more than seven days, we can pause your sessions and access until it is paid. The amount still owed remains due, and we may take reasonable steps to recover it, including recovery costs where the law allows.

9. Refunds and cancellations

Please read this before you buy. By completing a purchase or signing a Coaching Agreement, you confirm you have read and accept it.

9.1 Private coaching

All coaching payments are final and non-refundable. This includes payment-plan instalments. There are no pauses, suspensions or cancellations once the Coaching Agreement is signed, unless we agree to one in writing at our discretion. Coaching places are limited, and when you take one, we hold that time for you and turn other people away.

9.2 Digital products

Digital products are delivered straight away. Once you have access, all sales are final and non-refundable.

9.3 When we do refund

  • You were charged twice, or charged the wrong amount.
  • A digital product doesn't work and we can't fix it or give you working access within a reasonable time.
  • The law where you live gives you a right to a refund that can't be waived. See 9.4.

9.4 If you live in the European Union or the UK

Consumers in the EU and the UK have a legal right to cancel many online purchases within fourteen days. Where that right applies to you, these rules replace sections 9.1 and 9.2 where they differ.

  • Digital products: at checkout you ask us to give you access straight away and you acknowledge that, once access begins, you lose the fourteen-day right to cancel.
  • Coaching: when you ask us to start within fourteen days of signing, for example by booking your first session in that period, you acknowledge that if you cancel within the fourteen days you pay for the coaching already provided, in proportion to the full program, and that once the program has been fully provided you can no longer cancel.
  • To cancel within the fourteen days, email [email protected] with a clear statement that you are cancelling. You can use these words: "I hereby give notice that I withdraw from my contract for [the product or program], bought on [date]. Name, address, date." We refund any amount due within fourteen days of receiving it, using the payment method you used.

Nothing on this page removes rights you have under the consumer protection laws of the place you live that cannot be removed by contract.

10. Payment disputes and chargebacks

A chargeback is when you ask your bank or card company to reverse a payment. It costs us fees and time whatever the outcome, and it is almost never the fastest way to sort a problem out.

  • Contact us first. Before you dispute any charge, you agree to email [email protected] with the details and give us at least five business days to put it right.
  • You agree not to dispute a valid charge. To the extent the law allows, you agree not to start a chargeback or payment dispute for a purchase you authorised and that was delivered as described, including coaching sessions you missed or chose not to use, a payment plan you agreed to, or a change of mind. The Coaching Agreement contains the same commitment.
  • What we send your bank. If a charge is disputed, we will respond with the records we hold. That can include your signed Coaching Agreement, your acceptance of these terms at checkout, your application, invoices and receipts, session dates and attendance, booking and rescheduling history, assessment completion, messages between us, platform access and login records, and, where relevant, session recordings. You agree we can share these with the payment provider for that purpose.
  • What happens during a dispute. We can pause access to coaching, products and the community while a dispute is open. If you withdraw the dispute or it is decided against you, the amount stays due, and we may recover it along with reasonable recovery costs where the law allows.
  • Real fraud is different. If you think your card was used without your permission, tell your bank, and tell us too so we can cancel access and help.

11. How we ask you to behave

In the community, on live calls, on WhatsApp and anywhere else you deal with us or other members, please don't:

  • harass, threaten, abuse or demean anyone, or post hateful, sexual or violent content;
  • share anything another member says in confidence, or record or screenshot other members without their permission;
  • sell, advertise or recruit without our written permission, or send spam;
  • post anything you don't have the right to share, or anything unlawful;
  • copy, resell or distribute our paid content, or share your login;
  • try to break, overload, scrape or misuse the website or tools, or send false data on purpose.

We can remove content and suspend or close accounts that break these rules, without refund.

12. Recordings, testimonials and case studies

  • Coaching sessions are recorded. By signing the Coaching Agreement, you consent to every session being recorded and transcribed. We use recordings to prepare for and review sessions, to keep the coaching quality high, to analyse transcripts, and to build anonymised program data.
  • Anonymised use. We may use recordings, transcripts and assessment data with your name and identifying details removed for any lawful purpose, including improving the coaching, research, case studies, marketing and publications. We don't publish your recording, image or voice without your separate written consent.
  • Attributed use needs your separate OK. We will not put your name or identifying likeness next to a specific quote, statement or detail without your separate written consent for that use.
  • Testimonials you give us. If you give us a testimonial, review or story and agree to it being used, we can use it, with your name, image and voice as you agreed, for marketing and education, in any format and without payment.
  • Live group calls. Group calls may be recorded and shared with members or used in edited form. If you don't want to appear, keep your camera off and use a first name or display name.
  • Ownership. Recordings, transcripts, derivative works and anonymised data created from our programs belong to EverydayAction. Your personal information in them is still protected by the Privacy Policy below.
  • Don't record us without asking. Please don't record a session or call yourself unless we both agree first.

13. Our content and what you can do with it

Everything on EverydayAction, including text, videos, courses, worksheets, tools, the Growth Blueprint, the eight pillars, assessments, designs, logos and the EverydayAction name, belongs to us or our licensors and is protected by copyright and trademark law. You may use what you access for your own personal, non-commercial use. You may print and keep your own results. You may not copy, share, resell, teach, adapt or publish our materials, or use them to train an AI model, without our written permission.

14. What you post

You keep ownership of what you post in the community or send us. You give us a worldwide, royalty-free licence to host, display and use it to run the community and the service. If you send us ideas or feedback, we may use them without paying you or crediting you. You are responsible for what you post.

PART 2

Disclaimers

15. Coaching, not therapy

EverydayAction provides coaching and education. It is not therapy, counselling, psychotherapy, medical care, or a substitute for any of them. Eric Fate is not a licensed therapist, psychologist, physician or other licensed health professional. We don't diagnose, treat or cure any physical or mental health condition. Nothing on this site, in a product, on a call or in coaching is medical or mental health advice. If you need that help, it is your responsibility to see a licensed professional, and you shouldn't stop or delay professional treatment because of anything you learn here.

If you are in crisis or thinking about harming yourself or someone else, stop and get help now. In the US, call or text 988 (Suicide and Crisis Lifeline) or call 911. In the EU, call 112. In the UK, call 999 or Samaritans on 116 123. Elsewhere, call your local emergency number. If there is abuse, fear or danger in your home, contact emergency services or a local support line. Coaching and WhatsApp are not an emergency service.

16. Not legal, financial or tax advice

Nothing here is legal, financial, investment or tax advice. Talk to a qualified professional before making legal or financial decisions.

17. No guarantee of results

We make no guarantee of any result. Coaching is a joint effort, and what changes for you depends mostly on you: your effort, consistency, decisions, health and circumstances, many of which are outside our control. We don't guarantee any personal, professional, behavioural, health, financial or other outcome, and there is no money-back or results guarantee on any program.

18. Testimonials, case studies and numbers

  • Testimonials and case studies come from real clients and describe their own experience. They are not typical or average results and are not a promise of yours.
  • Our published case studies are built from a small number of clients, and we state how many. Assessment scores are each client's own ratings of themselves.
  • The clients whose words and results we share include one who knew Eric personally before coaching and one who received coaching at no charge. We don't pay clients for testimonials. We disclose connections like these next to the testimonial or case study they apply to.
  • Case studies are anonymised. Names and details may be changed to protect privacy.

19. Physical practices

Coaching can include simple physical practices such as movement, breathing exercises, sleep routines and changes to eating or drinking habits. Check with your doctor before starting anything new, especially if you have a health condition, are taking medication or are unsure. Stop any practice that causes pain, dizziness or discomfort. You take part at your own risk.

20. Earnings

We make no promise about income or financial results. Any figures or stories mentioned are examples only and shouldn't be relied on.

21. Information on the site

We work to keep what we publish accurate, but content is for general education, may become out of date and may contain mistakes. Research and statistics we quote belong to their authors.

PART 3

22. Third-party services

We rely on other companies to run EverydayAction, including Kajabi for the website, checkout, email and community, Zoom for video calls, WhatsApp for chat, and payment and scheduling providers. Your use of their services is also governed by their own terms. We aren't responsible for their services, outages or content, or for websites we link to.

23. The service is provided "as is"

To the fullest extent the law allows, the website, products, tools, community and calls are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the site will always be available, uninterrupted or free of errors. Some places don't allow these exclusions, so some of them may not apply to you.

24. Limitation of liability

To the fullest extent the law allows, our total liability to you for any claim connected with EverydayAction, in contract, tort or otherwise, is limited to the amount you paid us for the product or program the claim relates to. For anything free, it is limited to $100. We are not liable for indirect, special, incidental or consequential damages, or for lost profits, lost data, business interruption or the cost of substitute services, even if we were told they were possible.

Nothing in these terms limits liability that can't legally be limited, such as liability for death or personal injury caused by negligence, for fraud, or, for consumers in the EU and UK, liability for gross negligence or wilful misconduct.

25. Indemnity

To the extent the law allows, you agree to cover us, our owners, staff and contractors against claims, losses and costs, including reasonable legal fees, arising from your breach of these terms, your misuse of EverydayAction, or content you post.

26. Disputes and governing law

  • Talk to us first. If you have a complaint, email us. For a problem with a charge, section 10 applies. For anything else, we'll try to resolve it informally within thirty days before either of us takes it further.
  • Governing law. These terms and any dispute about them are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
  • Courts. Disputes will be decided only by the state or federal courts located in Delaware, and you and we agree to their jurisdiction.
  • Consumers outside the US. If you are a consumer living in the EU, the UK or another country whose law gives you mandatory protections or the right to bring a claim in your local courts, you keep those rights. This clause doesn't take them away.

27. Ending your access

You can stop using EverydayAction at any time. Closing your account doesn't cancel amounts you already owe under a payment plan or Coaching Agreement. We can suspend or end your access if you break these terms. Sections that by their nature should survive, including payment obligations, intellectual property, recordings and case studies, disclaimers, liability, indemnity and disputes, survive after access ends.

28. General

  • Changes. We may update this page. The date at the top shows the latest version. For material changes, we'll give notice by email or on the site. Continuing to use the website after a change means you accept it. Changes don't alter the terms of a purchase or signed Agreement made before the change unless you agree.
  • Electronic agreement. You agree we can contract and communicate with you electronically. Electronic signatures, checkout boxes and emails count as being "in writing" and are as binding as paper.
  • Force majeure. Neither of us is responsible for delays or failures caused by things outside reasonable control, such as illness, natural disasters, internet or platform outages, or government action. We'll work together to reschedule affected sessions within the program window where we reasonably can.
  • Severability. If any part of these terms is unenforceable, it is limited to the minimum extent needed and the rest stays in force.
  • Entire agreement. These terms, together with any signed Coaching Agreement and the in-tool notices described in section 3, are the whole agreement between us about their subject.
  • No waiver. If we don't enforce a term straight away, we can still enforce it later.
  • Assignment. You can't transfer these terms. We can transfer them as part of a sale, merger or reorganisation of the business.
  • Copyright complaints. If you believe something on the site infringes your copyright, email us with the work, where it appears on the site, your contact details, and a statement that you believe in good faith the use isn't authorised and that your notice is accurate.
  • Accessibility. We want everyone to be able to use the site. If something doesn't work for you, tell us and we'll help you another way.

PART 4

Privacy Policy

This policy explains what personal information we collect, why, who we share it with, how long we keep it, and the rights you have. It applies to everydayactioncoach.com, our products, community, calls, coaching and our messages with you, including Instagram, email and WhatsApp.

P1. Who is responsible for your information

Charest-Weinberg Gallery, LLC, doing business as EverydayAction, is responsible for your personal information (the "controller" under European law). Contact: [email protected]. Mail: 3411 Silverside Road, Tatnall Building, Suite 104, Wilmington, DE 19810, USA. We serve people mainly in the United States, and also clients in other countries, including Europe. Where European or UK data protection law applies to you, this policy is written to meet it.

P2. What we collect

What you give us directly

  • Contact and sign-up details: name, email address and, sometimes, phone number, when you join the newsletter, sign up for a live call, download a resource, use the contact form or create an account.
  • Clarity call application: your name, email, phone number, country, city or time zone, how you heard about us, and your answers about your goals, challenges, past experience, values, readiness and commitment, a general income range, and whether you are in a position to invest in coaching.
  • Purchase details: what you bought, when, and how much, and your billing name, email, address and country. Card and bank details go directly to the payment processor. We don't see or store your full card number.
  • Coaching records: the signed Coaching Agreement, session recordings and transcripts, AI-generated session summaries, the coach's notes, your arrival and weekly assessment answers, work you complete, and messages with us on WhatsApp and email.
  • Community and calls: your profile, posts, comments and messages, and your image, voice and name on recorded live calls if you choose to appear.
  • Messages on social media: when you message us on Instagram, we receive your username, profile details and the messages you send. Some replies are automated.
  • The Mental Load Conversation and The Handoff: these tools keep your answers and what you type with names removed, plus basic usage and device information. We don't store your names, email or IP address from them. Your full results with names stay in your own results link and your browser. The notice inside each tool has the details.

What we collect automatically

  • Device and usage information such as IP address, browser, device type, pages viewed, referring site, time on page, and whether you opened or clicked our emails. This is collected through our platform providers, cookies and similar technologies. See P8.

What we receive from others

  • Payment confirmations and fraud checks from payment processors and buy-now-pay-later providers.
  • Booking details from scheduling tools, and call details from Zoom.
  • Information from social platforms when you interact with our accounts or ads, and from people who refer you.

P3. Sensitive information

Coaching is personal. In applications, sessions, assessments and messages, you may tell us about your mental or physical health, sleep, energy, stress, alcohol or eating habits, relationships, family, finances or beliefs. Some laws call this "sensitive" or "health" information. We use it only to coach you, to measure your progress, and, with your identity removed, to improve the program and build anonymised research and case studies. We never sell it, and we never use it to target advertising. You choose what to share. We ask for your separate, explicit consent before we collect it, with a consent box on the application and in the Coaching Agreement. You can withdraw that consent at any time by telling us. We then stop collecting it and delete what we hold that identifies you, unless we have to keep it by law. Anonymised data already created can't be traced back to you and stays. Withdrawing consent may mean we can't continue coaching you.

P4. How we use your information, and our legal reasons

European and UK law asks us to name a legal reason (a "legal basis") for each use. Here they are side by side.

  • To provide what you asked for, such as delivering products, running your account, coaching you, scheduling sessions, sending session materials and your progress summary. Basis: performing our contract with you.
  • To review applications and decide fit for coaching. Basis: steps you ask for before entering a contract.
  • To take payments, keep financial records and meet tax and legal duties. Basis: contract and legal obligation.
  • To record and transcribe sessions and analyse them, including with AI tools. Basis: performing our contract with you and, for health information, your explicit consent.
  • To handle sensitive information shared in coaching. Basis: your explicit consent.
  • To send you our newsletter and marketing emails. Basis: your consent, or our legitimate interest in emailing customers about similar offers. You can unsubscribe at any time.
  • To measure and improve the coaching, our content and the website, and to create anonymised research and case studies. Basis: our legitimate interest in running and improving the business, and consent where required.
  • To run advertising and measure it. Basis: your consent where the law requires it, otherwise our legitimate interest.
  • To keep EverydayAction secure, prevent fraud, enforce our terms and respond to payment disputes. Basis: our legitimate interest and legal obligation.

What you have to give us. To apply for coaching we need your name, email, phone number and application answers. To buy, we need your name, email and payment details. To coach you, we need to record sessions and receive your assessments. Without these we can't provide the service. Everything else is optional.

P5. How we use AI tools

We use AI services to help transcribe and summarise sessions, analyse transcripts and assessment data, draft materials, and draft or automate some replies on Instagram and other channels. AI helps the coach. It doesn't replace him. We don't use AI to make decisions about you that have legal or similarly significant effects. For session recordings, transcripts and assessments, we choose business or developer versions of these services whose terms say they don't use your data to train their models.

P6. Who we share it with

We share personal information only as needed, with:

  • Service providers who run the business for us, under contracts that require them to protect it and use it only for our purposes. These include: website, checkout, email and community (Kajabi); payment processing (such as Stripe, PayPal, Klarna and Afterpay); video calls and recording (Zoom); chat (WhatsApp, owned by Meta); e-signature (Dropbox Sign); file storage, documents and forms (Google Workspace); scheduling tools; Instagram messaging automation (such as ManyChat); AI providers (such as Anthropic); and productivity tools we use to organise our work.
  • Advertising and analytics partners, such as Meta, when we use pixels or similar tools. See P8.
  • Payment providers and banks, when a payment is disputed, as described in section 10.
  • Research partners, such as a university, but only anonymised data that can't identify you.
  • Professional advisers such as lawyers and accountants, under confidentiality.
  • Authorities, when the law requires it, or to protect someone's safety, our rights or the rights of others.
  • A buyer or successor, if the business is sold, merged or reorganised, under this policy.

P7. We don't sell your personal information

We have never sold personal information for money and we don't intend to. Some US state laws treat using advertising pixels and similar tools to show you ads on other sites as "sharing" or "targeted advertising," even with no money involved. You can opt out of that at any time. See P8 and P13. We don't knowingly sell or share the personal information of anyone under 18.

P8. Cookies and tracking

Cookies are small files stored in your browser. We and our providers use them, along with pixels and local storage, to:

  • Make the site work: logins, checkout, security and your preferences. These are necessary.
  • Understand how the site is used: page views, traffic sources and email opens, through Kajabi's analytics and, where enabled, tools such as Google Analytics.
  • Advertise and measure ads: through tools such as the Meta Pixel, which tell us whether an ad led to a visit or sign-up and help show our ads to people likely to be interested. We don't send what you tell us about your health to advertising platforms.
  • Save your progress: The Mental Load Conversation and The Handoff keep your results in your own browser's storage so you can come back to them.

You can block or delete cookies in your browser settings. Blocking necessary cookies may stop parts of the site working. To opt out of ad tracking, use the settings in your Meta and Google accounts, your device's ad settings, or industry tools such as optout.aboutads.info, or email us with "Opt out" in the subject line and we'll stop sharing your details with ad platforms. Where the law requires consent before non-essential cookies, such as in the EU and the UK, we ask for it.

P9. Emails and messages

  • We send account, purchase and session emails because you need them. You can't opt out of these while you are a customer or client.
  • Marketing emails go to people who signed up or bought from us. Every one has an unsubscribe link, and we act on it promptly.
  • WhatsApp is used for coaching support with clients. We don't add anyone to WhatsApp for marketing.
  • We don't currently send marketing text messages. If we ever do, we'll ask for your separate consent first.

P10. How long we keep it

  • Newsletter and contact details: until you unsubscribe or ask us to delete them. We keep a minimal record of an unsubscribe so we don't email you again.
  • Applications that don't lead to coaching: up to two years, then deleted.
  • Purchase, invoice and tax records: up to seven years, as tax and accounting rules require.
  • Session recordings and transcripts: for as long as you are a client and up to three years after your last session, so we can support you if you return and deal with any dispute. Then we delete them or remove anything that identifies you.
  • Other coaching records (the signed Agreement, assessment scores, notes and messages): up to seven years after your last session, to keep accurate program and legal records.
  • Once your program has ended and nothing is owed or disputed, you can ask us to delete identifiable coaching records sooner. We'll tell you what we can delete and what we have to keep.
  • Community posts: until you delete them or close your account.
  • Anonymised and aggregated data can't identify you and may be kept indefinitely for research and to show results over time.

P11. How we protect it

We use reputable providers, access controls, two-factor authentication where available, and limit access to the people who need it. No system is completely secure. If a breach affects your information, we'll tell you and the authorities as the law requires.

P12. International transfers

Our providers mainly store and process data in the United States, and we may access it from other countries where we work, including in Europe. When personal information from the EU, the UK or Switzerland is transferred to the US or another country without an adequacy decision, we rely on safeguards such as the EU-US Data Privacy Framework, where a provider is certified, or the European Commission's Standard Contractual Clauses and the UK equivalent.

P13. Your privacy rights

Wherever you live, you can ask us to:

  • tell you what personal information we hold about you and give you a copy, in a portable format where possible;
  • correct information that is wrong or incomplete;
  • delete your personal information;
  • stop sending you marketing, and stop using your information for targeted advertising or any "sale" or "sharing";
  • withdraw consent you gave us, including for sensitive information. This doesn't affect what we did before.

US residents. Several states, including California, Colorado, Connecticut, Delaware, Oregon, Texas, Virginia and others, give residents specific privacy rights. Some of these laws may not apply to a business of our size. We honour the rights above for everyone anyway. We won't treat you differently for using them.

EU, UK and Swiss residents. You also have the right to object to our use of your information based on legitimate interests, to restrict how we use it, and to complain to your local data protection authority, for example the AEPD in Spain or the ICO in the UK. We'd be grateful for the chance to sort it out with you first.

Limits. We may keep information we need to meet legal or tax duties, resolve disputes, enforce agreements or prevent fraud. Anonymised data can't be traced back to you, so we can't find or delete it. This includes the anonymous answers kept by The Mental Load Conversation and The Handoff.

P14. How to use your rights

  • Email [email protected] with "Privacy request" in the subject line. Unsubscribe links work for marketing emails on their own.
  • We'll confirm your identity, usually by checking you control the email address we have. An authorised agent can act for you with your signed permission.
  • We'll respond within 45 days, or within one month for EU and UK residents. We may extend that once when the law allows, and we'll tell you why.
  • Appeals. If we decline your request, you can appeal by replying with "Privacy appeal" in the subject line. We'll respond within 45 days. If you are still unhappy, you can contact your state Attorney General or your data protection authority.

P15. Children

EverydayAction is only for adults. We don't knowingly collect personal information from anyone under 18. If you think a child has given us information, tell us and we'll delete it. Clients sometimes mention their children in coaching. We treat that information with the same care as everything else and use it only to coach the client.

P16. Consumer Health Data Notice

Some US states, including Washington, Nevada and Connecticut, have laws about "consumer health data." This notice explains how we handle it.

  • What we may collect: information you choose to share about your physical or mental health, such as stress, mood, energy, sleep, exercise, eating or drinking habits, conditions or treatment, in applications, coaching sessions, assessments and messages.
  • Why: to coach you, to measure your progress through assessments, and to produce your progress summary. With your identity removed, to improve the program and create anonymised research and case studies.
  • Where it comes from: you.
  • Who we share it with: only the service providers that store and process it for us, such as Kajabi, Zoom, Google Workspace and our AI transcription and analysis providers, and authorities if the law requires it. We never sell consumer health data and never use it to target advertising.
  • Your consent: we ask for your separate consent before we collect it, with a consent box on the application and in the Coaching Agreement. You can withdraw consent at any time, as described in P3.
  • Your rights: you can confirm whether we hold your consumer health data, get a copy, ask for a list of the providers we shared it with, and have it deleted. Use the steps in P14.

P17. Notice for California residents

In the last twelve months we collected these categories of personal information, from the sources and for the purposes described above: identifiers (such as name, email, phone, IP address); customer records (such as billing details); commercial information (purchases); internet activity (site and email activity); approximate location (country, city or time zone); audio and visual information (session and call recordings); professional or financial information you choose to share (such as an income range); inferences (such as program fit and progress); and sensitive personal information you choose to share (such as health information). We use sensitive personal information only for the purposes the law allows, such as providing the services you asked for, so we don't offer a right to limit its use. We keep each category for the periods in P10. We disclose categories to the service providers listed in P6. Advertising pixels may count as "sharing" identifiers and internet activity, which you can opt out of. We don't sell personal information and we don't offer financial incentives for it. California residents may also ask, once a year, about disclosures for direct marketing. We don't make those disclosures.

P18. Changes to this policy

We'll update this policy when our practices change. The date at the top shows the latest version. If a change materially affects how we use information we already have, we'll tell you before it takes effect.
